In a major setback to the Chhattisgarh Congress govt and a shot in the arm of the cooperative movement of the country in general and that of Chhattisgarh in particular, the double Bench of the Chhattisgarh High Court has set aside the state govt decision to remove elected heads from co-operative societies in the state.
Headed by Chief Justice Ramachandran, the bench observed that the order of the state govt to remove elected heads and installing administrators is wrong. “We annul your order”, the Honorable Court observed.
The High Court judgement has been welcomed by the co-operators of the state who always felt that it is wrong for a political party to meddle in the affairs of cooperatives.
Talking to Indian Cooperative Ashok Bajaj, a senior co-operator of the state welcomed the decision and said the Court decision would immediately help restore elected heads in 1333 cooperative societies of the state.
It bears recall that the Baghela govt had in July this year installed administrators in the name of reorganizing co-op societies removing the elected Chairmen and the elected boards.
These boards had completed only 2 years out of their tenure of five years. Now with this judgment in their favour they would complete their tenure and would be in office for the next three years, informed Bajaj.
Interpreting the High Court judgement Bajaj said “the govt may go ahead with reorganizing co-ops but not by installing their men. They can continue with the elected heads in chair, was the observation of the court.” “The elected heads cannot be removed for no reasons”, was the observation of the Bench, underlined Bajaj.
Besides, Chief Justice Sri Ramachandran, Justice Sri P P Sahu was the second judge who delivered the judgment setting aside the state govt decision.
