R.Vaidyanath

The secretary of our MC went abroad for 4 months. I would like to know if he has to seek leave of absence or appoint someone in his place of 4 months to manage the affairs of the society.

Second question is what is defined as common space? Does member need to ask the permission of the MC for renovation (painting or say installing AC) if the secretary is overseas how does one do it.

I C Naik

1.Secretary has to attend himself every meeting of the Committee and takes notes and prepare minutes. If he is absent Chairman has to door somebody else does, So Chairman’s permission is necessary. If in your case no permission was obtained, he has ceased to be a committee member for remaining absent in 3 consecutive meetings of the Committee without prior approval.

2.Common space has not been defined so far, but it is not difficult. Uncommon space must belong to somebody. Common Place can not belong to any body and no part of common place can belong to anybody except to the society. Go to the following website

https://sahakarayukta.maharashtra.gov.in/SITE/PDF/Rules_Acts_Bylaws/Model_Bye_Laws_of_Coop_Housing_Society_New_Flatowner_Type_(2-9-14)%20(1).pdf

and find more information in Clause (xx)(xxi) and (XXII) of Bye Law 3.

3.Every  member needs to ask the permission of the MC for renovation ( painting or say installing AC) If the secretary is overseas an application addressed to Chairman must be submitted at least 15 days in advance.
