An inquiry officer was appointed under the section 88 of Maharashtra State Cooperative Societies Act who imposed a penalty on the chairman  and 23 other directors in the wake of the bank going into a crisis.

DIRECTORS APPROACHED ME.

they are guided to file case against coop. department officers ,dy. registrar and other authorities.

to safeguard them from action, this will be a good step to proceed against Department.and bring them to books about their responsibility.

if required these directors can approach High Court .

I C Naik

What is the offence  committed by an authorized person by conducting an inquiry and slapping a penalty if he has found grounds and acted in accordance with law?  Better Course is to make revision application under Section 154. And even if the officer has made a mistake he is an authority under law andcan not be sued personally for whatever he has done.
