I am a resident of a new apartment in Mumbai. The administration is still under control of builder and society registration

?is just done last month

. Builder plans to handover society by Diwali this year

?, and has asked us to select members for provisional managing committee for a period of one year?

.   I would like to know:

1.?How is the Provisional managing committee selected. Can we have ballot system and ask members that whoever is interested can submit application.

2.We are 71 members in the society. What is the Minimum and Maximum strength of the Provisional managing committee. ?

3.We need to open Bank account for collecting maintenance and payments to housekeeping, security , electric bills, etc.  In which Bank /s , can we open the account. How would be the mode of operation.

its good that the builder has alerted you in advance. You have enough time to make good preparation. Get hold of the registered bye-laws of the Society from the Builder. As the Society is just registered the builder would have registered Model 2014 as your society bye laws. For abundant caution obtain that original and if it is as per Model 2014 buy a few copies from Mumbay District Cooperative Housing Federation. It costs Rs 80/-. Compare it with the registered one there will be a few gaps filled in by hand, which ou copy in your set. Make as many sets as the number of members of adhoc committee Go through the same carefully for about a week individually and collectively. Now go to www.indiancooperative.com. 1.The Provisional managing committee is a part of Agenda of the very first GBM the Developer is to convene and preside. (Go thrugh patiently B L Numbers 85-93) You can have  ballot system and ask members that whoever is interested can submit application.

2.BL N 114 has a table fixing  excat strength of the Committee. You have to elect Members accordingly. No more or no less.

3.Builder has opened a Bank account the operation of which has to be changed as per Bye Law number 113.
