Query of Ambika C K

Mr. I C Naik by Mr. I C Naik

I  am posting this query  from Thane Maharashtra.where I stay..Somebody in our society wishes to rent out his apartment to 9 bachelors and the owner had approached the society for an NOC.The committee members are divided in  their views—some feel he may be permitted to rent out to bachelor tenants and some against it.

Legally I think the society  cannot object isnt it.Prior to this we have not had such a situation in our society. If the committee gives the green signal and all other residents learn about this later on there is likely to be a huge hue and cry.

But the point is this:Is the Managing Committee within its rights to refuse to give NOC to the member for letting out to multiple tenants.Does the Managing Committee have the  right to refuse  NOC on the ground that there are so many tenants.

Kindly favour us with  your valuable advice.

I C Naik
