I am member of Veer Hanuman Nagar CHS, Kandarpada, Dahisar-W, Mumbai68, regd in 1984-85. Our present MC is elected in 2012 and as the Bye Laws adopted and appvd by Dy.Registrar of Coop.Soc., Mumbai, the tenure of MC is 3 yrs. However, now as per amended Sec.73cb of MCS Act, the tenure is automatically fixed as 5 yes. Hence, can our Soc. go in for election after 3 yes I.e. in 2015 or we have to wait up to end of 5 years ie. up to 2017?. Our Society has total 136 members falling under cat.D.

Quote 3. The term of the office of the elected members of the committee and its office bearers shall be five years from the date of election and the term of the office bearers shall be co-terminus with the term of the committee Unquote

As per Sub-Section 14 The committee of every co-operative society shall, –

(a)inform the State Co-operative Election Authority about the expiry of its term of office at-least six months before the date of expiry of such term;

These changes came in to effect from 14 2 2013. These are binding on all societies.
