My wife owns a flat in a registered co op Society which has been in the grip of rogue elements.
She has paid Rs.2500/- towards her share of registration cost in 2007 but due to my objections to fraudulent dealings and siphoning of funds by managing committee my wife has not been issued share certificates under the pretext that my agreement is not registered although I have paid full stamp duty as abdujudicated by the department.

 It is impossible to grasp a  real question so as to be of help to the aggrieved Husband Naval.

1.Cooperatives being State subject name of the State is required.

2.Committee members are doing service free and out of volition so in attaching motives one need not do haste.

3.To whom She has paid Rs.2500/- towards her share of registration cost in 2007 is not clear. The Committee is not responsible for “registration’

4.Amount payable for purchasing shares works out to Rs 250/- if  a zero is added accidentally, no way of assuming.

5.it is not clear if Rs 100 being admission fee was paid or not.

6.it is not clear if application was made.

7. Itis not clear if application to become member has been made.

8.is it only an issue of share certificate having complied with everything except registration of the stamped agreement.

??Admitting a person to membership of the CHS is taken for granted by the purchasers of flats..Beyond that they do not try to understand the procedure of membership as laid down in the bye laws. certified copies of bye laws of the society in which a person buys a flat is available for just Rs 100 (approx). Every CHS has its own bye laws which governs its operations.

Absence of share certificate for a few more days will not matter. so get a copy of the bye law and after stdying write a nice logical detail letter as to how the committee was in the wrong to have not issued the share certificate. The Share Certificates are issuedge of the committee in accordance with the bye laws and if you think your wife has complied fully you should have no difficulty in pointing out the Committee’s error successfully, systematically and contributed decisively to the knowledge base of the society. There may be only misunderstanding on the part of both avoidably making you angry with your well-meaning committee. So be constructive.
