I am a resident of Vikas Complex, Thane – Mumbai

Can a member be elected as a Office Bearer or a Managing Committee Member, having more than two children, all born before 1993.

Following proviso inserted by the Maharashtra Co-operative Societies (Third Amendment) Act, 2001 exempts members of the society from disqualification on account of two children who were having more than 2 children born before 7 9 2001.

Provided that, a person having more than two children on the date of commencement of the Maharashtra Co-operative Societies (Third Amendment) Act, 2001[1] (hereinafter in this clause referred to as “the date of such commencement”),shall not be disqualified under this
clause so long as the number of children he had on the date of such commencement does not increase:

[1] Clause (vii) was inserted by Mah. 34 of 2001, s. 6, w.e.f 7-9-2001.
