Uniform Bye-Laws for Co-op Housing Societies in Maharshtra

In a significant step towards modernising the cooperative housing sector, the Maharashtra Government will introduce a uniform set of Model Bye-Laws for over 1.25 lakh cooperative housing societies across the state from October.

 A committee headed by Deputy Registrar Rajesh Lavhekar has been tasked with drafting the revised bye-laws, with the exercise now in its final stages. The new framework has been aligned with the Maharashtra Co-operative Societies Act and recently notified government regulations.

The updated bye-laws will bring uniform rules on maintenance charges, tenant documentation, non-occupancy charges, parking management, statutory annual audits, and financial governance.

They will also lay down comprehensive provisions relating to society objectives, membership, share capital, fund management, and expenditure planning.

The revision comes after more than a decade, replacing the 2014 Model Bye-Laws, which were framed before the rapid expansion of high-rise residential towers and large housing complexes.

    Need to know two flats are join (area 1375 sqft builtup) and convert to one flat, haveing a MOU for 10000 sqft carpet. But BMC plans show the flats as two separate units. Can they pay one maintenance.

    Even after the existing bye-laws clearly stipulating directives for various areas of operation and rules for the housing societies, there is a rampant violation of them due to arbitrary ways of the Managing Committee and many times of the Members themselves acting in vested groups.
    Instead of new law, effective implementation of existing law with swift redressal of complaints is required.

    New bye laws needs to address non occupancy charges more fairly. It is capped @10 percent of the maint. Charges instead noc be charged 10′ on monthly rent or maint charges whichever is higher. This is because many soc. are charging mint charges which are very low whereas the rent is charged much higher in the past couple of years.

    Dear Noel, you will have to pay maintenance charges for 2 flats as approved in the plan & BMC will charge as per the built up area on capital value system ( Ready Reckoner rates).
