The Federation of Karnataka Apartment Cooperative Societies (FOKACS) has raised alarm over restrictions on apartment owners’ right to form cooperative societies, which they say violates Supreme Court rulings and the 97th Constitutional Amendment under Article 19(c), media reports say.
At a press conference, FOKACS president Parasuraman T K emphasized that the denial of this right undermines land ownership protections. He argued that without co-op status, owners lose compensation rights in redevelopment or land acquisition cases.
Resident Shailesh added that without a society, owners lack legal standing in disputes, despite paying for both land and housing.
