Housing co-ops drag RERA Act to court

Hearing a clutch of petitions filed by cooperative housing societies raising questions about the constitutional validity of the provisions of the real estate Act 2016, applicable to them, Karnataka High Court issued notice to the Union and State governments, reports Hindu.

The petitioners- have questioned the constitutional validity of Sections 3, 4 and 13 of the RERA, which imposes many “unreasonable” restrictions, including the retrospective application of the provisions of the Act, on the activities of co-operative societies or co-operative housing societies.

The petitions claim the RERA threatens their rights under the Karnataka Co-operative Societies Act-1959.

Application of RERA will also affect the ongoing projects of the CHS, the petitions argue. Next hearing will take place in August.
