The Supreme Court has once again emphasized the need for simplicity in administrative procedures, this time quashing a 2009 Jharkhand government directive that added an extra verification step for stamp-duty exemption to cooperative societies.
A bench comprising Justices P.S. Narasimha and Atul S. Chandurkar ruled that the additional certification was “unnecessary, excessive and illegal,” observing that it created avoidable procedural hurdles.
The court clarified that once a cooperative society is duly registered, its registration certificate stands as conclusive proof of existence, eliminating the need for further verification.
