SC overturns decision of expulsion of Sunil as MLC

Though the Biscomaun election results are yet to be in his favour, Bihar co-operator Sunil Kumar Singh has won a crucial battle in the Supreme Court. The apex court has overturned the decision on his expulsion as MLC.

In a significant judgment, the Supreme Court has overturned the expulsion of Biscomaun outgoing Chairman and RJD MLC Sunil Kumar Singh, providing major relief to the senior leader who is also a prominent co-operator.

A Bench headed by Justice Surya Kant ruled that Singh’s expulsion from the Bihar Legislative Council for his remarks against Chief Minister Nitish Kumar was “highly excessive and disproportionate.” The court emphasized that expulsion from the House is a serious action and should only be exercised in exceptional cases.

It bears recalling that Singh was expelled from the Council on July 26, 2024, following allegations of unruly behavior. The motion for his removal was passed a day after the ethics committee submitted its report, accusing Singh of sloganeering against the Chief Minister on February 13, 2024, and mimicking his body language. He was also charged with questioning the competence of the committee members.

Singh, a close aide of RJD supremo Lalu Prasad Yadav, welcomed the court’s decision, calling it a victory for democracy. The ruling is expected to have political ramifications in Bihar, strengthening Singh’s position within the RJD and impacting the state’s cooperative sector.

Sunil is currently locked in a separate fight with the govt on the issue of voting rights of nominated members in the BISCOMAUN Board.

The Bihar government has appointed three directors to the board of the Bihar State Cooperative Marketing Union Limited (BISCOMAUN), a move expected to significantly impact the upcoming elections for key office bearers.

Reacting strongly, Sunil Singh criticized the move, calling it unprecedented in India’s cooperative movement. He claimed that no state government has ever issued such a directive before the board’s formation, nominating three private individuals to the board.
