GBM authorized to decide on use of terrace

My grandmother who is 95 year old resides with us on the third floor (top floor) of the society in Vasai Maharashtra. As per doctor’s advice she is supposed to take about half an hour sun bath in the morning and evening and take little walk.

For last three months our terrace has been closed which was kept open for past 17 years by the new MC. Till August my father was either secretary or chairman of the society from 1997. There are three senior citizens in my house I have a pet to safe guard them (a Labrador ) which is 9 months old.

About three months back on one particular day my grandmother left the main door open inadvertently and my dog went to terrace and jumped on one of the members who was walking on the terrace. My daughter who ran after the dog caught it was about to bring it down when this person abused her and asked her not bring the dog to the terrace.

When the new committee was formed this person became one of the office bearers and he was instrumental in forcefully locking the terrace. The office bearers say the terrace will be only available for functions with prior permission. I had written a letter to Dy registrar of societies and he signed the letter and asked to submit to the society which I did but the society did not bother to take any action on this letter also.

I have also sent a lawyer notice to the society even then they did not open the terrace. When asked the reasons they kept replying it closed for security reasons where as this new committee has installed two cameras on the terrace. But finally after a big fight they have agreed to open the terrace only in the evening for two hours.

Please guide me what should I do further

Use of terrace is to be regulated by the general body decisions. So you need to take support of other members and requisition a special General Body Meeting to discuss the business of using terrace. 1/5th number of members need to sign the requisition.
