AGM fails to adopt accounts

Nandan Adhikari

I stay in Cooperative housing society having 168 members in Dombivali Maharashtra. Our MC held AGM on 28/9/2014 for which the account details were circulated 1 week before. In the AGM they have not appointed Auditor and not adopted the accounts by saying the accounts reflect some wrong amounts and there is no audit report available with them.

On the contrary they showed letter from auditor mentioning audit report not ready and adopt the account in AGM without Audit report. The AGM was not adjourned. No accounts were shown thereafter. Even after 2 months the MC is reluctant to show any accounts.

What is the solution? We have already filed complaint with Deputy registrar but without any result. Also given request for SGM with 1/5th members signature. The same was not done and the same is also being informed to the Deputy registrar.

Accounts need not be circulated if they are displayed on the Notice Board 14 clear days prior to the date of A G M. The Cooperative Department seems to have now become active after new Government in the State assumed office. Meet the Dy Registrar once again or write to him about these serious irregularities. The Chairman Secretary could be dismissed and will be disqualified to hold elective post for five years. Of course the Registrar must be satisfied about truth in you complaints.
