Mysore based Advocate K S Nagaraju has filed an RTI in Agriculture Ministry wanting to know the status of Mohan Kumar Mishra in the National Council for cooperative Training (NCCT).

Raju’s RTI directed to Central Public Information officer in the Ministry K R Meena asks “Whether Mohan Mishra has been posted as Secretary in the National Council for cooperative Training [NCCT) of the Department of Agriculture, Cooperation and Farmers welfare on an absorption basis?”

If yes, whether at the time of Mishra’s absorption, the then Recruitment Rules permitted ‘absorption’ as one of the methods for such recruitment? RTI states demanding a copy of the relevant NCCT recruitment rules that empowered the absorption of Mishra shall be provided.

RTI reminds that immediately before his absorption, Mishra was holding the same post as Secretary NCCT on deputation basis/short term contract basis. Whether under the relevant DOPT provision, can a person get absorbed into the same post in continuation to the deputation tenure? If yes, a copy of the relevant provision shall be provided.

Other queries related to Whether Mishra was the only candidate who applied for absorption; Whether applications are invited from the market for appointment for the post of Secretary NCCT on an absorption basis?

Questions like whether at the time of absorption, the existing NCCT Recruitment Rules Prescribed “Absorption” as one of the sources of recruitment to the post of secretary NCCT are also being raised.

One of the important points raised in the RTI is “Whether “No Objection” was obtained from Mishra’s employer (lending organization – i.e., National Cooperative Union of India (NCUI) prior to initiation of the absorption process.

RTI demands a copy of such no objection received from NCUI regarding absorption of Mishra shall be provided and asks whether the post held by Mishra in NCCT carries a pay scale of Level 13 in the 7th CPC pay matrix?

It also wishes to know if the absorption proposal was concurred by the Union Public Service Commission [UPSC] and Department of Personnel and Training (DoPT].
