Co-op Housing Society: New members can vote

Some time back a question came up before Indian Cooperative wondering if new members are eligible for voting in the affairs of the cooperative housing society within a period of two years of joining.

Sub-section (3A) of section 27 of the M. C. S. Act 1960 provided that “an individual member of a society shall not be eligible for voting in the affairs of that society for a period of two years from the date of his enrollment as a member of such society”.

The two year embargo was relaxed for cooperative housing societies in 2003 vide Notification – The Maharashtra Co-operative Societies Act 1960.

No. VIPRAAA-2001/16593/PRA.KRA.163(A)/15-S published in the Gazette of Government of Maharashtra, Co-operation, Marketing & Textile Department Mantralaya, Mumbai, Dt. 29th October, 2003.

Now once for all the exemption of 2 year condition has found place in the M. C. S. Act 1960 by way of a Proviso to above sub-section as reproduced below:

“Provided that, nothing in this sub-section shall apply in respect of a co-operative housing society and a co-operative premises society.”
