General Body can change tenure of Chairperson : HC

A cooperative society can amend its bylaws to extend the term of its chairperson, ruled Bombay high court.  “Such an amendment cannot be said to be contrary to the provisions of the Maharashtra Cooperative Societies Act”, nor could it be said to be contrary to the cooperative movement, Court said

The matter related to Nashik District Central Co-op Bank Ltd. General Body had increased the tenure of Chairman from 12 months to 30 months.

The court ruled that the tenure of a chairperson is a subject matter which is in the realm of the society’s general body and it can never be said to be in violation of statutory provisions of the Act and contrary to the cooperative movement.

The order of a single judge was set aside by the High Court.
