Officials of Registrar of Cooperative Societies are let off

Delhi court Special Judge R P Pandey discharged the Registrar of Cooperative Societies officials S D Sharma and Debajit Dutta at the stage of framing of charges due to lack evidence against them.

Matter pertained to Rs 4,000 crore scam of fraudulent allotment of land to defunct cooperative housing societies. They have been discharged by a Delhi court for want of evidence.

“I find that there is no sufficient evidence available against accused S D Sharma and Debajit Dutta to frame charge against them for criminal conspiracy with other accused under section 120B IPC (criminal conspiracy) or under provisions of Prevention of Corruption Act (relating to bribe and abusing official position). As such both of them are discharged,” the ASJ said.

The court also transferred the case for further trial of eight other co-accused to a magisterial court, saying that with the discharge of two government officials, it ceased to have jurisdiction over it.

The court said that after the trial against public servants under the PC Act is over, the court ceases to have jurisdiction in respect of other accused persons, booked for cheating and forgery, and referred the matter to the Chief Metropolitan Magistrate.
