Tuition classes: Society harasses my mother

Jaya Hemrajani

We live in Kolkata, West Bengal in a cooperative housing society. My mother takes tuitions at home just for three hours in a day. We are following all the rules such as no parking of visitor’s car in the premises etc. However, there are people in the building who harass my mother mentally. I had read that taking tuitions in a residential appt is not considered as a commercial activity as no buying or selling takes place. Please help me as to what should be done in order to get rid of all problems and let my mother continue taking tuitions without any harassment. Kindly, advise a peaceful & an appropriate legal way.

The Management Committee has the responsibility to regulate the user of the flat as notified to member via Flat Allotment Letter. Every member of chs has to give an undertaking as per bye laws which include the user of the flat to be restricted to what is written in the bye-laws. Every society has its own bye laws and hence in order t advise a correct course of action consulting the bye laws is a MUST. Change of User to flat is not an easy thing and the MC is normally right.
