Too late to raise a dispute after 10 years

I bought a flat in December 2005 in my wife’s name. We were third party. We took possession of our flat in January 2006. Society levied 50% on maintenance fee as non-occupancy charge as we didn’t paid transfer fee to society but was occupying our flat with family. We later paid transfer fee after a year.

Until then non-occupancy charge and 21% interest on the charge was levied on us as penalty for late payment. Kindly let us know it was legitimate or not. Because to my knowledge non-occupancy charge was be levied when flat is let or sub-let on rental basis.

If charge is not valid, can we dispute this to claim a reversal of the charges and interest.

It  is too late to raise a money dispute after almost 10 years. Not advisable on the face of it  as litigation costs will far outweigh the benefit and even if it is an “ego” issue not worth it. Time barring arguments itself will add to the litigation costs.You may get nothing except paying for  litigation costs.
