Query of Shailesh Chandrakant Sabnis

I am staying in a MHADA colony comprising 13 buildings at Vakola Santa Cruz. We have limited space for parking in our colony.

Fortunately our building have some open space but that does not belong to our society.

However Car owned by members staying in our society are parked in such way that if any emergency occurs we cannot remove our cars. Members park their car saying land do not belong to society so they can park the way they intend. Please advice.

“Fortunately our building have some open space but that is not own by our society.”

This is funny. But…

Find out who owns the open space. The owner should prosecute the trespassers. If owner is not interested, pass a resolution in General Body Meeting to regulate parking in the space the owner is not interested to manage. Include in the resolution a clause that If any member disobeys General Body Meeting diktat, he will be expelled from the membership forfeiting his interest in the property of the society.
