Our society in Kalyani Nagar Pune have shifted Garbage Station at the Exit gate thereby blocking the exit gate completely. The society has one main gate and two exit gates. We are about 125-150 tenements and looking at the size of the society these 2 exit gates are important. I therefore need to know

  1. Can the society block these gates?
  2. In case of any emergency can the society be held responsible
  3. Is there any ground/provision of law whereby Society can be prevented from blocking the exit gates?

Such matters are normally decided by members by passing a resolution as provided under the registered bye-laws of the concerned housing society.

So I suggest you go through the registered bye-laws of your housing society which you are entitled to through (free of cost). You can get a copy certified by the Hon. Secretary as “registered bye-laws in force”   at a copying costs at actual.

After going through the relevant bye-laws you may still not be clear then you may please refer to me with year and number of Registration of your society as also scanned copy of bye-laws you have referred to.
