I had paid my society my property tax regularly from the time i had purchased the flat, but it was found that my flat was not there on property card so society had not paid my dues to bmc , recently after approaching bmc , society had paid my dues which is very less than the amount i had paid to the society ,

Now BMC had raised the bill from 2010-15 without any interest and society had make the payment for the same, where as the property was active from 2006 and i had purchased the flat in 2008.

i had  approach bmc official and asked that do i need to do any extra payment, and they said all my dues are clear and there is no dues left , they agreed to give me writing.

i had asked society to refund the excess amount and interest  amount  they had earned  by not making payment to bmc and earned interest on it by making fd.

Society is not agreeing, they are holding my funds and arguing that bmc can always come and asked for property tax for period 2006 – 2010.

Please suggest a solution.

You give an undertaking to pay BMC demands as and when raised. If no refund is given file criminal case of fraudulent withholding of money, excessive demands collected and not passed on. Before prosecution is launched sk for prior permission of the Dy registrar of your ward. Prosecute office bearers also along with the society.
