Builder is delaying the formation of society for long time and now it looks like it is not going to be formed.

Can we go ahead and for a Cooperative Housing Society without builders consent if yes what are the steps?

And in Goa any Good Consultant is available who can help us in forming a Cooperative Housing Society?

As per Section 7(2)(b) of Goa CS Act 2001 any 5 adults belonging to 5 different families can sign an application for Registration. Builder’s consent is not necessary. It is assumed that the builder has handed over possession of dwelling units to parties with whom sale agreements have been executed and registered with the registrar of properties, after obtaining clearance of civic authorities to occupy the property.  For a lawyer you can consult Cleofato Almeida Coutinho – who is a senior lawyer and one of the constitutional expert in Goa.
