Illegal penalty in mumbai sir I have extended the size of my window without touching any beam pillars no structural alteration has been made by me I am a mc member but because some mc members are siphoning funds out of society I complains to registrar because of this the society has started penalty per month Rs 7500 please advise what is to be done repeated letters to secretary chairman are not replied and my penalty amount is becoming big every month pl advise sir

Please check whether Penalty is levied after following the procedure laid down in bye Law No. 166 (check exact number in your CHS bye Laws).

  1. The meeting of the general body of the society may prescribe penalties for different breaches of the bye-laws of the society. The Secretary of the society, under instructions from the Committee, shall bring to the notice of the member concerned, the breach/breaches of the bye-law/bye-laws committed by him. If the member persists on continuing the breach/breaches, the Committee shall give the notice to the member to show cause as to why the penalty should not be inflicted on him for breach/breaches of the bye-law/bye-laws. The general body meeting, after considering the say of the member and after giving him hearing, may levy penalty at the rate fixed by the meeting of the general body of the society.

Write to Secretary to veriy it and ask to show to you which bye law has been breached by you. Till then no need to pay.
