We have a query regarding a hotel owner who has a 3bhk flat in our society, the owner  of the hotel does not stay here and his servants  and waiters of more than 30 stay here in this flat and spend society water ,creating problems to other members of the society.

A few questions:

1.is there any restriction on members staying in a own flat?

2.how do we charge maintenance amount for this flat?

3.Does he need to provide police verification of all the members staying in his flat?

I C Naik

Rules of occupancy of a flat in CHS are given in the registered bye-laws of the Society. A copy of these  Bye laws as certified by the Secretary that they are in force can be obtianed from Secretary paying cost of making copy. So go for it. Grab a copy of Bye Laws and you will know what is wrong in a member letting any body occupy a flat instead of himself. This member can be expelled from the CHS if majority members (not less than 3/4 of the members present in the General meeting) so decides and get permission of the Registrar. Procedure is as per Bye Laws Section 35 of MCS Act 1960 Rules 28/29 of MCR 1961. ?
