Our Society is a commercial complex at CBD Belapur. I have some queries and need your guidance:

  1. a) To induct new members what is the number of shares applicable as per Clause 19 (a) (i).

    Is it ten shares or twenty shares? Any circular to that effect?

  1. b) The newly elected committee secretary has taken over after due election process and

    he is taking major decision of inducting new members, fixing parking fees and its allotment.

    Is it mandatory to call General body first after new committee took over or else can the

     be taken and ratified later by General body?

  1. c) New Model Bye laws of 2014 is not yet adopted and approved, so before taking any decisions do we need to first get the byelaws approved?

The questions you have can be answered only by going through the registered bye-laws of your cooperative society which is a commercial complex. Model Bye-Laws are recommendatory and if adopted it makes the life of those in management easy as taking decisions reading old (registered bye-laws ) Bye-Laws may result in (unknown) violation of provisions of law/Rules.  It is not obligatory to adopt new Model.

If you are keen to find answers get a certified copy of registered bye-laws of your society paying copying costs (your right under law and Bye-Laws ). While undertaking the study any doubts arise in your mind do let me know I will certainly guide you.
