I am the Secretary of Kirankunj CHS (Registered) located in Malad West, Mumbai, Maharashtra State. Total number of members: 29

1. Managing Committee members: 11 as per the Old Byelaws 1984(October edition)
2. Adopted the New Model Byelaws 2014 in the SGM held in December 2014. Submitted documents related to Election to the Deputy Registrar in Jan 2015 and requested them to conduct elections as per the New Model Byelaws.  The Deputy Registrar while accepting the Docket verbally indicated that a Special Election Officer will visit the Society to conduct Elections. Till date, Old MC is continuing with 11 members in absence of any communication from the Deputy Registrar.

III.As advised by the Electoral Office recently, we are in the process of submitting the FINAL E3 format to the Election Officer by December 4th, 2016.

Please advise on the following:

As per Clause 114 of the New Model Bye Laws, 2014, the Committee shall consist of 11 members (for Society strength less than 100 members) which includes 3 members of SC/ST, OBC and NT as per reservation.

Our Society does not have any members subscribing to the above 3 categories.

In such a scenario:

1)    Can we fill these 3 vacancies (SC/ST/OBC/NT) from the General Category?

2)    What will be the Quorum for the Managing Committee meetings in case we cannot fill these seats with the General Category members?

As advised by the Electoral Office recently, you are in the process of submitting the FINAL E3 format to the Election Officer. I suggest you write a letter along with this format as suitably drafted on the basis of a letter one CHS in R South Ward has addressed to Election Officer. The draft is attached.
