Our committee member (secretary) have not taken a single monthly meeting in previous year 2015-2016,he also not deposited maintenance cash in societies bank account.

In AGM which was held on 07/08/2016, i ask them why they have not deposited cash in bank account since last six month and why they have withdrawn cash regularly from bank account though the cash book showing cash in hand more than 20000.They were unable to give answer. They(secretary, president and tresurer) were blaming on each other, hence AGM insisted them to resign. They also have given resignation and three new members have been co-opted in managing committee.

Hence my question is- can AGM co-opt the committee member?

There are two critical legal issues of serious consequences. Unless there are a few 3-5 extremely sincere and well meaning members in a housing society a life can be hell for the entire population. I am glad there are a few here in yor housing society.

The first issue is Money Laundering by Office bearers.

The legal provision is U/S 81(6) enables the Society to approach the Deputy Registrar to order re-audit. This should be resorted to.

The legal provision about filling up casual vacancies (which were filled up by AGM) is that inform Ward Cooperative Election Officer that three casual vacancies have taken place in the management committee and election may be held to fill them up.
