I have the following query:

1. Can a member of the cooperative society, who is not in the Managing Committee, call for a meeting of society members by circulating a memo not signed or Authorised by Secretary/ Chairman.

2. The called meeting is attended by handful of residents, which include tenants and the minutes of the meeting is thrust upon the Managing Committee stating is it is the will of the members of the society.

The core motive seems to pressurise the Managing Committee into implementing certain rules which is suitable to the selected group

If the answer to above is ‘No’ then what legal action can the society initiate against this member and under which section of bye-laws and to which govt Authority it can be filed.

I C Naik

BEST option is to ignore this event as if it has not happened. When the Committee meeting is convened next lude in the agenda any matter of substance was found in the matters handled by the dissatisfied group but without overt recognition.
