Thank you for your valuable guidance which you are providing over your website.

I am right now struggling with my case with Housing Society located in Malad west, Mumbai.

My mother has purchased one flat from Builder in the redeveloped society. Currently I am not admitted as member. Now she has let out the flat after completing the police verification, registered Leave & License agreement and we intimated to the society one month before regarding letting out the flat. They told us that since building is still not handed over you approach builder and builder told us that its ownership flat you can let out.

After almost two month,  now society is saying tenant will have to vacate the house as I have not taken NOC. Also they said, society will take interview before giving the permission.

I have read several news and opinion as as per that NOC is not mandatory from society. You are kindly requested to guide me, how should I take this further as I am getting daily call from society on this matter and they are threatening me to lock out the flat.

Kindly advise how should I take up the matter to close this issue amicably

Any question in CHS can not be answered accurately without looking relevant provision of bye laws. If your Society’s bye Laws are as per Model 2014 then you are right if not do as the society says.
