Query of Mrs Zainab Deshmukh

I have purchased a shop in a registered CHS, which has 4 shops. All the shops are lacking water taps or wc facilities. Society is collecting more maintenance from shops than the flat owners

whereas even not providing any water or wc facility.

What action we can take against the CHS?

I C Naik

The determination of maintenance charges is governed by the Bye Laws and Society in General Meeting of in Committee cannot fix any rate not conforming to the provisions of Bye Laws. So get a copy of the registered bye-laws of your  society certified by the Secretary that they are in force. You will be asked to bear the Xeroxing costs. If you find that higher Charges are collected fro shops all Shop owners can take it up as provided under Bye Laws 174-176.
