I PURCHASED A FLAT IN MUMBAI IN 2007. SELLER WAS ALLOTTED STILT PARKING IN 2001. SOCIETY REGISTERED ON 2002. CONVEYANCE OF SOCIETY IS NOT DONE SO FAR.  IN JAN.2011 M.C DISSOLVE ALL THE STILT PARKING OF THE SOCIETY ALLOTTED BY THE BUILDER IN VIEW OF RECENT SUPREME COURT JUDGEMENT AND CALLED A SGM TO DECIDE ALLOTMENT OF STILT PARKING, THOUGH M C COULD NOT SUCCED ON THE ISSUE. I THEREFORE WANT TO KNOW WHETHER I CAN PURCHASE STILT PARKING FROM SELLER OF MY FLAT NOW TO AVOID ANY  DISPUTE IN FUTURE.

 Your Bye Law No 78 reads as under:

(a) Member may hold Parking Spaces/stilt if he has purchased the same and he shall have a right to sell the same to transferee or other eligible members of the same society.

MC has breached iety wants to go by the SC Order. this bye law. You can compalin to Cooperative Court against this under Section 91.

Despite SC order the Bye Laws have to be amended if the Soc
