In my building 5/16(31%) flats are on leave and licence basis, at about Rs30000 pm for over 7 years. This is causing a problem in running the society. There is no manpower to manage the admin. They do not become Secretary, for example-they are not available for repairs/monitoring, etc.

These members do not involve themselves in the management of the society yet get a good amount by way of rent because the society is being run well…cleanliness, good water and elec, peaceful environment, maintenance, etc.

They refuse to voluntarily pay 5 or 10 % of the rent. The maintenance expenses are rising and they want all members to pay. If members object to pay, they raise a hue and cry. For them they expect others to subsidize the maintenance.

The byelaw is old and conservative and states only 10% of maint charges. What is the way out? Can the society levy some charge on NOC, or pass a resolution for donation, etc?

As 31% flats are sub-let there is no manpower to manage the admin. Their members do not become Secretary, for example. These flat-owners are not available for repairs / monitoring, etc. These members do not involve themselves in the management of the society. But earn a good amount by way of rent because the society is being run well…cleanliness, good water and elec, peaceful environment,maint, etc. They want all members to pay maintenance. As per bye-laws NOC is only 10% of maintenance.

So what is the problem? Everything is going on well and clean up your mind that Licensors are better placed than those who stay. Work out % yield of Rent less payments to society on present value of flats.And see how well they earn.
