With effect from 13 2 2013 under New Section 73CB of MCS Act 1960 its Sub-Section applies to all Elections in Cooperative Societies namely
The superintendence, direction and control of the preparation of the electoral rolls for, and the conduct of, all elections to a society shall vest in the authority called as the State Co-operative Election Authority’, as may be constituted by the State Government in that behalf. Every general election of the members of the committee and election of the office-bearers of a society including any casual vacancy, to the extent applicable, shall be held as per the procedure prescribed.
U/S 73 Sub Section 1 reads (1) The management of every society shall vest in a committee, constituted in accordance with this Act, the rules and by-laws, which shall exercise such powers and perform such duties as may be conferred or imposed respectively by this Act, the rules and the by-laws.
Thus your Committee elected on 15 8 2014 does not have power to manage your CHS.
