Query of Dilip Narkhede

Myself, Dilip Narkhede, cashior of Suryakiran Co-op. Housing Soceity Ltd. Plot No.29/30, Sector 6, Sant Nagar, Moshi Pradhikaran, Pune 412 105.

some of our society members have irregularly paid their society maintenance charges every year. Every year we have issued a notice to them.

Now this year, again, we have issued a notice to pay the maintenance charge with Rs.300/- per month penalty. We have given a dead line to pay the charges till 30th June 2016. However, after issuing this notice, still the member;s does not pay the charges to the society.

My question is – shall i cut water supply for these society members? as the supply of water is a society responsibility. Society have paid the combine water charges on behalf of all the members.

Or please suggest what action we have taken against this members.

It appears you are not aware that there are bye-laws which your housing society has registered. If you are a cashier ( employee and not a treasurer, please pardon mee for this onservation but it is imporatnt). Delayed payment consequences are to be decided in line with bye laws [the existence of which your unaware, about]. Tnis is a domain of the management committee and you must consult secretary or treasurer if any.

Bye-laws provide for fixation of simple interest rate which has to be decided in general body meeting, with a ceiling of 21%. Fixing Rs 300 per month is not permissible.

As the delayed payment has a penal interest there can not be any other penalty.

So do nothing now. If the outstanding goes very high say 12 months or 24 months then approach the Registering Authority for certificate of recovery Under Section 101.
