I am a member of Co-Op.Housing Society in kolkata,West Bengal.Can you kindly enlighten me whether a member of the Housing Society can provide tuition to the students from his flat while residing there in with his family.? Kindly provide me judgement , if any passed by the Hon’ble Apex Court of the Country?

User of a residential flats is governed by Civic Authorities in terms development control rules under which Building Plans are approved for a purpose. These are not uniform across States. Next is the Committee of every housing society which should be guided by the registered bye-laws of the concerned housing society . this is not a matter needing attention of any legal authority as these are covered by regulatory regime and there is no big legal issue involved.
