A housing society has to maintain the following registers pertaining to its members,

– Share Register; Share Ledger; J Register;  I Register

I am trying to understand the purpose of these registers and how to make entries to them during transfer process, death of members etc. So far I have not found any information regarding this on the internet. Kindly help me if there is some documentation regarding this in co-operative manuals or acts etc.

There is an annexure being a Xerox of page No 38 of Bye-laws. When your society was registered the Model available was of 2001. I have a printed copy of this Model published by the District Housing Federation which does not have a provision on legal expenses.  So you need to have a certified copy of the relevant Bye-law No which has been relied upon by the Society. I also need to see relevant papers to proceeding before the Minister to see if the Committee’s decision to hire and advocate could be covered by provisions of Bye-law No 138 extracted below:

“The members of the Committee shall be jointly and severally liable for making good any loss, which the society may suffer on account of their negligence or omission to perform any of the duties and functions cast on them under the Act, Rules and the bye-laws of the society.”

Apparently the bye-law as per Xeroxed enclosure is against the interest of member who is not responsible for a decision of the Society to hire lawyers’ services. On the whole such claims are untenable. You should try to know from the DR if you can attend the hearing as the Notice is not addressed to you.
