I write to you as the Secretary of Lodha Eternis Coop Hsg soc ltd based in Mumbai. We wish to seek you advise on the case where builder is not willing to pay the maintenance charges for the period before the formation of the Coop society. some of the facts of the situation are as follows:

Date of Applicable CAM: Date of possession or date of Occupation certificate (OC) OC received in Oct 2013  (Which ever is earlier)

CAM for 2 years taken in advance by builder.

Society formed and handed over on 6 Dec 2015.

We want builder to share the burden of CAM charges (76 Lacs) for Period the first flat was given possession till society formation date.

Builder citing following clause in the sale agreement with various purchasers to decline payment of CAM:

Any grievance against builder is best redressed by District Consumer court. You can see some of the cases on this side itself. It is quicker and effective.
