Am staying in society in Hiranandani estate in Thane, my managing committee has has passed a resolution with the help of few members to collect a sum of Rs 25000/- over & above the regular monthly maintenance charges, which also they increased by 40% in the society general body meeting.

Can members challenge such a decision taken in the general body meeting?

File a Complaint in Cooperative Court as provided under Bye law No 175 relevant extract is reproduced below.

[B] CO-OPERATIVE COURT

Disputes between the members and/ members and society. Which falls under Section 91 of the Act, such as:-Dispute pertaining to:-

  1. Resolutions of the Managing Committee and General Body

Before filing a dispute make sure certain procedures are complied. There are prescribed in Bye law No 173 and 174 and U/S 148 (3)
