Query of Anil Palan

I would like to know whether I can insist on the Managing Committee of Housing Society to permit me to verify certain entries which I doubt are of irregular nature.

I had requested but the Society has informed me that the same was put in AGM and is approved by the General Body so the same cannot be allowed to be reopened.

If it is permitted please advise me the Section of MCS Act and Bye-Law under which I can request.

Member’s right to inspect records of his/her housing society is regulated by specific provisions under the MCS Act 1960, the MCR 1961 and also by their respective registered bye laws.

The records listed for this purpose are as under:

  1. A copy of the Act, the rules and the by-laws,
  2. the last audited annual balance sheet, the profit and loss account,
  3. a list of the members of the committee a register of members,
  4. the minutes of general meeting,
  5. minutes of committee meetings and
  6. those portions of the books and records in which his transactions with the society have been recorded.

The records you want to have a look at are obviously not covered in the above list.
