My society has appointed a person as secretary, is it a valid appointment.

Regarding appointment of a person secretary who is not mc member please note the following:

1.Bye Law No 125(a) requires. Every Committee, at its first meeting, after its election shall elect a Chairman, Secretary and Treasure from amongst the Members of the Committee.

2.To operate a bank account of the Society  bye law number 113 requires that ” the account shall be operated upon and all acquaintances and discharges shall be signed by the Secretary jointly with the Chairman or Treasurer.”

3.There are more than 20 functions listed under Bye Law No 140 are required to be performed by a Secretary appointed under Bye law No 125(a).

4.His presence in the meeting of MC will not count in quorum nor he can vote on any matter voted by the Committee.

Let the Committee decide how it wants to manage its society with a person as Secretary who is not one of its members.
