Query of Agnish Raikwar

I am a member of a co-opoerative housing society in Maharshtra (kalyan). Two months back, I have rented my flat & on the same, I started paying 10% extra maintenance to respective CHS. Also this extra charges were agreed by secretory of society.

Now suddenly, CHS have refused to accept my paid maintenance with extra cost. Now they are pressurizing me to pay 50% extra on normal maintenance.

Pl. guide me on this matter.

You write a letter requesting the Secretary to go through the Sdate etate Government Order (effective 1-08-2001) issued under section 79 A of the Maharashtra Co-operative Societies Act 1960 on levy of NOC published in Housing Manual accessible on following URL

Important directions in the order is as under (on Page 69/70:

  1. 2. Non-Occupancy charges shall not exceed 10% of service charges. (excluding Municipal Corporation/ Municipal Taxes).
  2. All the housing Societies in the state shall take action to make proper amendment as above their bye-laws/ sub-rules. However, even if no amendment as above has been made, non occupancy charges should not be charged more than maximum limit mentioned in this order from the date of this order
