My question is whether an Associate Member can question the Membership of another Member? If so, under which section of MCS Act,1960?

 A person has become Associate Member by paying an entrance fee( As he is not joint property holder) and his entry is recorded in Share Certificate. As per Bye-Laws in force every share certificate and later on any changes recorded should be signed by all three office bearers viz. Chairman, Secretary and Treasurer and society seal should be stamped duly attested.

However in this case there are two conditions have not been fulfilled-(i) Signature of the Secretary is missing & (ii) Society’s seal is not stamped. I want to know whether in view of incomplete recordings the person can be considered as Associate Membership? Please guide.

Can Associate Member approach the Metropolitan Magistrate to file criminal complaint against office bearer? If so under which section/rule of MCS Act,1960.

The  Answer  is NO to the first point raised by you. In second point I see these as technical irregularities if other matters are not questionable. And again for the third point the  Answer is No.
