Query from Nitin More

Sir I am residing in Vasai west, Dist. Palghar.,   Maharashtra State,

Society Registration No. TNA (VSI) / HSG (TC) / 5000 / 92-93.

Since last 3 years no AGM called by Chairman/Secretary. Also Chairman is holding his post from almost last 18 years.

Kindly advise what we members to do and what is the punishment for this.

THE M C S ACT 1960 was substantially amended with effect from 14 2 2013. For members a duty of participation in management was provided for the first time vide a new section 26(2):

(2) It shall be the duty of every member of a society,—

 (a) to attend at least one general body meeting within a consecutive period of five years :

 If a member fails in this duty for consecutive two terms of 5 years he is liable to be expelled from the membership of the society.

With this failure to convene Annual General Meeting and get the accounts adopted by the members of the society has also been brought in to focus by enabling the Ward Deputy  Registrar to disqualify members of managing committee from being on the Committee for 6 years. A member should inform the Ward Deputy Registrar of cooperative societies about such failure.

There is no ceiling on years for which a member can hold any office in the housing society.
