I am a member of the Managing committee of a housing society – Anand lok Cooperative Housing society with 304 members in Mayur Vihar , Delhi .  We in the MC has decided to call for a special General body meeting  to decide about  the mode of road to be laid for the Internal road  of the society and the cost for the same to be approved .  The notice for the Special General body meeting with agenda details have been sent on 26th March 16 for the SGM to be held on 17th April16 Sunday at 9.30 am .

One of the members have sent an e mail request on 11th April16  to the Registrar of the Cooperative societies asking the registrar to stay the SGM called for .  My query is that can the registrar of cooperative society stay the SGM called for as per rules , on the request of one member ?  is there any legal provision for the registrar to do so ?

What is the legal remedy for the MS to follow in this case ?  please provide your advise on urgent basis since the SGM is to be held on this Sunday 17th Ap16.

Generally the Managements of Housing Societies avoid convening meeting of members and for that Registrar is empowered to convene under certain situations. Staying a meeting of member is not with in the power of the Registrar. In any case No order on nay matter can be passed without hearing the Chairman/Secretary.
