Can a registered member of a coop housing society park third party vehicle in the parking lot allocated to him by the society?

STATE MAHARASHTRA (MUMBAI DIDTRICT SUBURBAN)

REGN NO BOM/WR/HSG/TC/11880/2002

I C Naik

  1. A Housing Society registered in 2002 must have registered Model 2001 as its bye-laws.
  2. Parking Rules are specified in the registered bye laws No.78-85.
  3. Will look up relevant Bye-law to answer the following question
  4. Can a registered member of a coop housing society park third party vehicle in the parking lot allocated to him by the society?

Relevant bye-laws

  1. Bye-law No 78(a): “Parking Spaces/stilts allotted by the society, the member shall have no right to sell or transfer the said Parking Spaces/stilts to any body.”
  2. Bye-law No 81: “A member, having a motor vehicle, will only be eligible to have stilts or a parking space”
  3. Bye-law No 80:“The committee shall ensure that the space is used by the members for the purpose for which it is allotted to them”

I hope you can find the answer yourself.

In order to find answers to any question in future I suggest you exercise your right as per Bye-law No 22 namely:“A member shall be entitled to receive a copy of the registered bye-laws of the society on payment of the price thereof.”

Some times bye-laws do not provide clear answer and law may have to be referred to. In such cases you can write to us.
