Query from Hemant on amalgamation of flats

We have purchased one flat however builder has made two agreements of one flat only. Now one of the member has complained to BMC and they have sent us notice u/s. 347-C of the BMC Act and tell us to comply within 30 days.

We have wrote to Builder also but any how we have to reply within 30 days. Since we have not done any alteration in the flat. Flat was sold us as a single unit only.

Can you please advise what should be our action of plan. We are from mumbai.

Section 347C of BMC ACT read::Building originally constructed or authorised to be used for human habitation not to be altered without permission for the purpose of using it as  a godown, etc.

In order to give proper response the occupant need to know what is the crime has has committed? There is no need to be answerable for Builder’s fault.
