Query from Haji Shaikh

I have also a query if an Associate Member who do not hold any name in share certificate and  after filling the form 19 B & C and taking no objection from original owner and paying Rs. 100 as admission fee and got elected as associate member in society and later when society elections are held under election officer and he won and become treasurer and completed his full term can he again contest elections as some members have objected that associate member cannot contest elections whose name is not in share certificate

Rights of Associate Members are to be specified in Bye-Laws. Section 24(2) of the M C S Act 1960 “an associate member, may, …. have such privileges and rights and be subject to such liabilities of a member, as may be specified in the by-laws of the society.”

Your following question can be answered after finding out from registered bye-laws of your society whether the previous election of an Associate was correct as per Bye-Laws.

“When society elections are held under election officer and he won and become treasurer and completed his full term can he again contest elections as sone members have objected that associate member cannot contest elections whose name is not in share certificate “

So please find out from registered bye-laws the answer to your question with reference to previous election.

I can only say that none of the Model Bye-Laws 1984,2001,2009 and 2014 allows Associate to become a member of the Committee.
